Public contract (offer) for the order, sale, purchase, delivery of goods

TERMINOLOGY
1. Public offer (hereinafter referred to as the "Offer") is an offer of the Seller to an unlimited number of persons to conclude a contract for the sale of goods (hereinafter referred to as the "Agreement") remotely on the specified terms, including the Annexes.
2. Online store means a means for presenting or selling goods, works or services on the Internet by means of an electronic transaction by the Parties.
3. Order - selection of some of the goods from the list of goods, when the Buyer orders the goods, payment or order to buy and deliver the goods.
4. Seller - an individual/legal entity that sells goods published on the Website.
5. The Buyer is a natural/legal person who enters into the Agreement with the Seller on the terms described in the Offer.
GENERAL PROVISIONS
1. This Offer Agreement is an offer of TM "GNZ" (represented by the individual entrepreneur Bohdan Larysa), hereinafter referred to as the "Seller", to conclude a contract for the sale of goods through the online store remotely, hereinafter referred to as the "Agreement". The public offer is published in the public domain on the official website of the Seller "https://gnz.ua" (hereinafter referred to as the "Website").
2. The Buyer's payment for the ordered goods is considered acceptance of the offer to conclude the Purchase and Sale Agreement, agreement with the terms described on the website.
PRICE OF THE GOODS
1. The prices indicated on the Seller's website are considered current.
2. The right to change the price for any item of the assortment remains with the Seller.
3. The Seller shall be obliged to inform the Buyer of the change in the price of the Goods placed in the Order.
4. The Buyer reserves the right to confirm/refuse the Order in case of price changes after the previous Order. duly executed.
5. After payment, the price of the Goods cannot be changed.
6. The cost of delivery is indicated on the website and is negotiated by the Seller's representative when placing an order for the goods by phone.
7. The fact of receipt of funds to the Seller's account is considered a completed fact of payment.
8. The section "Delivery and Payment" describes the terms and methods of payment for the Goods by the Buyer.
PLACING AN ORDER
1. The Buyer can order any product from the website of the online store www.gnz.ua or in the Instagram application by communicating with the manager directly.
2. The Buyer is obliged to provide the following information to place an Order:
  1. NAME
  2. data for the delivery of the Goods,
  3. contact phone number.
3. The purchase amount, name of the Goods, quantity are indicated in the Buyer's basket when placing an Order on the site.
4. The Seller has the right to request additional information from the Buyer. In case of refusal to provide additional data necessary for the fulfillment of the Order, the Seller is not responsible for the timely provision of quality service.
5. The Seller has the right to register the Buyer's data in its own database without disclosing it to third parties. The Buyer agrees to the terms of the Offer by filling out a form with registration data on the Seller's website / providing information to the Manager.
6. The Buyer is responsible for the accuracy of the data specified when registering the Goods.
7. The sale and purchase agreement between the Buyer and the Seller is considered concluded remotely after ordering the Goods on the service of the store's website or issuing a cash or sales receipt to the Buyer to confirm payment.
TRANSFER OF GOODS TO THE BUYER, DELIVERY
1. The method, terms, conditions of delivery of the Goods are agreed upon by the Seller's representative during the Order.
2. Pickup of the goods:
  1. The Buyer can receive according to the Order on weekdays at the address: Kyiv, 86-P Kazymyr Malevycha St., calculation and receipt takes place on the spot.
  2. From the moment of receipt of the Goods by the Buyer, which is confirmed by signing the sales receipt / accompanying documents related to the Delivery, the ownership of the Goods passes to the Buyer.
3. Delivery is carried out with the participation of a third party (carrier).
4. Conformity of the Goods to the Order, completeness shall be checked by the Buyer in the presence of the Seller's representative or carrier.
RETURN OF GOODS
1. The return of goods in the online store is governed by the current norms of Ukrainian legislation.
2. The costs associated with the delivery of the Goods to the Seller, in case of return, shall be borne by the Buyer.
3. The Buyer's return of the Goods of appropriate quality, without damage, obliges the Online Store to refund to the Buyer the funds paid for the Goods, except for delivery costs, if any.
RESPONSIBILITY OF THE PARTIES
1. The Buyer and the Seller are responsible for improper fulfillment/non-fulfillment of the terms of the Offer provided for above and applicable law.
2. The Seller is not responsible for:
  1. insignificant discrepancy in the color scheme that differs from the original due to different color reproduction of PC monitors, phones;
  2. information provided by the Buyer when registering the Goods,
  3. interruptions, delays in the delivery of the Goods arising from reasons beyond the Seller's control,
  4. illegal actions of the Buyer using this access to the Internet.
3. The Buyer is fully liable in case of damage, even if another person worked under his/her login, to legal entities/individuals, the state, public morality, property.
4. Force majeure circumstances determined by the legislation of the state of Ukraine shall exempt the Buyer/Seller from fulfilling the terms of the Offer.

The Parties undertake to use exclusively the way of negotiations to resolve conflicts and problematic situations.
